Acceptance of Terms
ZAF TECH (“Provider”) provides software, Graphic assets and website services to you subject to the following Terms of Service (“TOS”). If you do not agree to the TOS, then you should not use the zaftech.org website.
Product License
The WordPress themes, plugins, extensions & snippets authored by Provider and/or provided on zaftech.org are licensed under the GNU general public license.
All Wordpress items listed in the ZAF TECH directory are developed by third-party developers and redistributed by ZAF TECH under the terms of the General Public Licence (GPL). ZAF TECH is not associated with or endorsed by the developers of any Wordpress items featured on this site and don’t offer any additional author services like author’s support and license keys (The lifetime membership includes license keys of All Divi Plugins and themes for unlimited websites which are integrated through Zaftech Support Team)
Refund Policy
All sales are final. The nature of digital media implies that once you have downloaded a plugin or theme there’s really no way to ‘return’ it. So, without product return the concept of justified refund gets imbalanced. However a refund is issued o customers on circumstances mentioned here.
Product Support
Provider products and designs are provided “as is”, with no implied warranty that they will function exactly as you wish or with all third party components and plugins. Apart from installation, we don’t provide support regarding plugin functioning except ‘Zaftech Plugin Manger’ which is our own product. Third-party products provided are supported by their authors and not by providers. Please review the support terms provided by the author of a product before purchasing it.
However, we do offer consultancy to our members which should be viewed as a welfare to our members nor an obligation at our end.
What Our Support Service Covers
We only support our Products (Currently Zaf Tech Plugins Manager), and additionally we offer basic installation support for all the products offered in this website. We also offer consultancy on general WordPress troubleshooting and web development but this should be viewed as a welfare to our members nor an obligation at our end.
And If you need professional support from the author you should consider purchasing the products directly from the authors.
Product Updates
Each individual membership purchased from Provider includes complimentary updates of all products for the complete duration of membership. If customers continue their membership, they will continue to receive updates up until the membership expires.
Our team keeps on updating products regularly (within 48 hours). ZafTech contains a vast library of theme, plugins and scripts it takes time and other resources to keep them fully updated to their latest version, yet we try our best to fulfill need of each customer.
Please Understand, We update products periodically and at times it may take a while to upload the latest version of a product that smoothly runs at your system without any license issue. In that case, we urge upon to have patience.
Membership Payments
There is NO AUTO RENEWAL. All payments are for ONE TIME. You can renew by yourself whenever you want.
Membership and/or Price Changes
We do not promise that any particular item will continue to be available on our website. We reserve the right at any time to modify or discontinue all or part of the downloads with or without notice. Further, we may add new downloads with or without notice. Prices of any membership are subject to change at any time by posting the changes to our website.
Customer Accounts
Customers will be required to create an account when purchasing any products. They are responsible for maintaining the confidentiality of their password and are not permitted to share and/or distribute their account login details. Customers are fully responsible for all activities that occur under their account and agree to immediately notify Provider of any unauthorized use of their account or any other breach of security. Provider will not be liable for any loss or damage arising from customer failure to comply with these terms. Please note that Provider requires that all users be over the age of 13 to have a customer account.
Account Termination and Suspension
Provider reserves the right to suspend and/or terminate any user account without notice, in its sole and absolute discretion. No refunds will be provided to customers who have their accounts terminated. Examples of reasons for termination include: 1) Abusive behavior and/or excessive negativity towards the Provider staff and/or other Provider customers; 2) Repeated defamatory, malicious, and/or false statements including slander against Provider, and/or attempts to persuade potential customers away from purchasing Provider products; 3) Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts; 4) Provider reasonably believes that your account has been compromised, shared with others, or for other security reasons.
Product Delivery
After Provider has successfully received customer payment, customer account login information will be emailed to the email address provided during signup. This may take up to 30 minutes after purchase but usually happens within 5-10 minutes.
Price/Product Changes
Provider reserves the right at any time to modify and/or discontinue a product with or without notice. Further, Provider may add new products and/or services with or without notice. Prices of any products are subject to change at any time by posting the changes to the Provider website.
Business Use Of Our Goods and Services
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Provider and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Good or Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
Product Warranty
Provider Does Not Provide Any Warranty
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER PROVIDER NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT ITS GOODS OR SERVICES. FOR EXAMPLE, PROVIDER DOESN’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE GOODS OR SERVICES, THE SPECIFIC FUNCTION OF THE GOODS OR SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.
Liability For Our Products And Services
WHEN PERMITTED BY LAW, PROVIDER, AND PROVIDER’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PROVIDER, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID PROVIDER TO USE PROVIDER’S GOODS AND/OR SERVICES.
IN ALL CASES, PROVIDER, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
Do We Provide Any Cracked File ?
The files are downloaded from the developers as it is. Then, certain changes are made to some files to ensure that these files work on your system without requiring license keys.
Demo Data of Themes and Plugins
Please note, we do not provide any license keys for our products. The products are configured to operate without a license. However, for some themes/plugins, the demo data/templates may not be available for download. This is because certain themes/plugins require approval from their respective developers (through a license approval) to download demo data/templates.
Miscellaneous
Updates To TOS. The TOS may be updated from time to time, but never retroactively. We will post notice of modifications to the TOS on this page, and they will become effective no less than fourteen days after they are posted. However, changes addressing new functionality, or to address changes in the law, or for other urgent legal reasons may be made effectively immediately.
Other Guidelines Or Terms. If there is a conflict between this TOS and those for a specific Provider service, the terms for the specific service will prevail.
No Third Party Beneficiaries. These terms control the relationship between Provider and you. They do not create any third party beneficiary rights.
No Waiver. If you do not comply with these terms, and Provider does not take action right away, this doesn’t mean Provider is giving up or waiving any rights, such as the right to take action in the future.
Severability. If a particular term in the TOS is not legally enforceable, it will not affect the other terms.
